These Terms & Conditions (“Terms”) constitute a legal agreement between you (referred to as “you” or “user”) and Maike Creations (referred to as “we,” “our,” or “Maike Creations”) for the use of the LinkGenius plugin (“the Plugin”) sold on all-affiliates.com. By purchasing, downloading, installing, or using the Plugin, you agree to abide by these Terms. If you do not agree with these Terms, please do not purchase the Plugin.
1. Plugin Licensing
1.1. The Code of the LinkGenius Plugin is licensed under the GNU General Public License (GPL) (http://www.gnu.org/licenses/gpl.html).
2. Ownership
2.1. You acknowledge and agree that all rights, title, and interest in and to the Plugin, including any intellectual property rights, are owned by Maike Creations. You do not acquire any ownership rights to the Plugin except for the limited license granted under these Terms.
3. Use of the Plugin and License
3.1. You are granted a non-exclusive, non-transferable, limited license to use the Plugin in accordance with these Terms.
3.2. You are not allowed to distribute, sell, rent, lease, sublicense, or otherwise transfer license keys or any of your rights and obligations under these Terms to any third party without the express written consent of Maike Creations.
4. Delivery
4.1. After the successful purchase of the Plugin, you will receive an email with any necessary credentials. You can then log in on your account page to download the plugin and obtain the required license key(s).
4.2. Your purchase includes a subscription to the Plugin, which will be automatically renewed until canceled by you.
4.3. Access to support and future updates will be provided to users with an active and paid subscription license key.
4.4. You may cancel your subscription at any time on your account page provided by Maike Creations. Upon cancellation, your access to support and updates will cease, and your subscription will not be renewed for subsequent periods.
5. Refund Policy
5.1. We offer a 14-day refund policy on all purchases of the Plugin. No refunds will be granted after 14 days from the initial purchase date.
5.2 If you have previously received a refund and purchase again at a later time, the new purchase will not qualify for the 14 day refund period.
6. Support
6.1. Maike Creations provides support for the Plugin to the best of its ability but does not guarantee that all issues will be resolved. We reserve the right to refuse support to any users or customers as we see fit.
6.2. Support is provided via a designated support system, and users must have a valid username and password to access support.
6.3. Access to support and product updates is provided for a term of 1 year from the date of purchase. After the initial purchase a yearly license renewal is required to continue receiving support and updates.
6.4 Maike Creations provides support for the LinkGenius Plugin only. We do not offer support for WordPress or other WordPress plugins we have not developed. We provide support for third party plugin conflicts at our discretion.
6.5 We take no liability for actions taken by site owners or our support team that result in website downtime, data loss, or any other problems while in the process of troubleshooting, bug fixing, testing, or otherwise.
6.6 License holders are strictly prohibited from reposting, sharing, or disseminating any support content, which includes but is not limited to emails, support tickets, recordings of phone calls, or recordings of screenshares, screen captures or reproductions of any support content, on external websites, social media outlets, or any other public platforms. Any violation of this policy will result in immediate and irrevocable termination of the license. In such cases, all access to support content, including product updates, will be discontinued.
6.7 None of the support content may be used as the basis for or part of any disputes arising from support or the use of our plugins. It is essential that support content remains confidential and is used solely for the purpose of resolving issues related to the Plugin.
7. Warranty
7.1. The Plugin is provided “as is.” Maike Creations does not guarantee compatibility with all third-party plugins, web browsers, or web hosts. We are not responsible for any conflicts or problems that may arise from using the Plugin.
8. Chargebacks & Bank Fees
8.1. License holders are required to contact Maike Creations first regarding any refund requests or inquiries related to unrecognized charges before initiating a chargeback request with their bank.
8.2. Maike Creations reserves the right to dispute chargebacks if it is determined that the charge is not fraudulent, and there has been no prior communication from the license holder regarding the issue.
8.3. Maike Creations will not, under any circumstances, reimburse license holders for banking fees, including but not limited to overdraft or currency conversion fees, incurred as a result of transactions related to the Plugin or these Terms & Conditions.
9. Price Changes
9.1 Maike Creations reserves the right, at any time and at its sole discretion, to modify or discontinue the pricing structure and licensing options for the Plugin, whether temporarily or permanently, with or without prior notice to users.
9.2. Prices for all products, including the Plugin, are subject to change. Notice of any price changes will be provided on the official all-affiliates.com website. It is the responsibility of users to review the pricing information regularly to stay informed of any updates or changes.
10. Acceptance
10.1. By purchasing, downloading, or using the Plugin, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
11. Governing Law and Jurisdiction
11.1. These Terms & Conditions shall be governed by and construed in accordance with the Dutch laws (laws of the Netherlands), without regard to conflict of law principles.
11.2. Any disputes related to these Terms & Conditions shall be exclusively resolved by the competent courts located in the Netherlands, and you consent to the personal jurisdiction of said courts.
12. Changes to Terms & Conditions
12.1. Maike Creations reserves the right to change or modify these Terms & Conditions at any time without prior notice. It is your responsibility to review these Terms periodically for any changes.
